ARBITRATION AND CLASS ACTION WAIVER

Any dispute arising from or related to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association. The arbitration shall take place in Denver, Colorado, and will follow the AAA’s commercial arbitration rules.

You agree to waive any right to participate in class actions or class arbitration. You also waive your right to a jury trial.

FORCE MAJEURE

Going Strategic shall not be held liable for any delay or failure in performance due to causes beyond its reasonable control, including but not limited to natural disasters, power outages, government actions, labor disputes, or disruptions in telecommunications.

REMEDIES

If you violate any of these Terms, Going Strategic may seek injunctive or equitable relief in addition to any other remedies available at law or in equity.

ACCOUNT DELETION

You may request deletion of your account by emailing [email protected]. Account deletion may take 7–14 business days. Going Strategic may retain certain information as required by law or for legitimate business purposes, including fraud prevention or compliance.

TERMINATION AND GOVERNING LAW

Going Strategic reserves the right to terminate your access to the Site at any time without notice, particularly if you violate these Terms. These Terms are governed by the laws of the State of Colorado. Any legal action or proceeding shall be brought exclusively in the courts of Denver County, Colorado.

CHANGES TO THESE TERMS

Going Strategic may revise or update these Terms at any time. The most current version will always be available on the Site. Continued use of the Site after changes are made constitutes acceptance of those changes.
